1. Description of Service
Model.beer is a web-based platform that provides access to multiple AI language models from various providers. Our Service allows users to compare responses from different AI models side-by-side. The Service is powered by Open WebUI, an open-source AI interface.
2. Account Registration
To use our Service, you must sign in using Google authentication. By signing in, you:
- Confirm that you are at least 18 years old or have parental consent
- Agree to provide accurate account information
- Are responsible for maintaining the security of your account
- Accept responsibility for all activities under your account
3. Subscriptions and Payments
3.1 Free Trial
New users receive a 3-day free trial with up to $1 USD worth of AI model usage. After the trial expires, you must subscribe to continue using the Service.
3.2 Paid Plans
We offer Monthly ($11.99/month) and Yearly ($120/year) subscription plans. Subscriptions include usage credits as specified in our pricing.
3.3 Usage-Based Billing
AI model usage is billed based on tokens consumed, at the rates charged by the respective AI providers. Token usage is deducted from your included credits. Current rates are displayed in the application.
3.4 Billing and Cancellation
Payments are processed by Stripe. Subscriptions automatically renew unless cancelled. You may cancel at any time through your account settings. No refunds are provided for partial months or unused credits.
4. Acceptable Use
You agree not to use the Service to:
- Generate illegal, harmful, or abusive content
- Harass, threaten, or harm others
- Violate any laws or regulations
- Infringe on intellectual property rights
- Attempt to circumvent usage limits or pricing
- Share account credentials or resell access
- Interfere with or disrupt the Service
- Attempt to reverse engineer the Service
We reserve the right to suspend or terminate accounts that violate these terms.
5. AI-Generated Content
The Service provides access to AI models from third-party providers. You understand that:
- AI responses may be inaccurate, biased, or inappropriate
- We do not guarantee the accuracy or quality of AI outputs
- You are responsible for how you use AI-generated content
- AI outputs should not be relied upon for medical, legal, or financial advice
6. Intellectual Property
You retain ownership of your input prompts. The intellectual property rights to AI-generated outputs are governed by the respective AI provider's terms. The Service itself, including our website design and branding, remains our property.
7. Data and Privacy
Your use of the Service is also governed by our Privacy Policy. You can export your conversation history at any time through the application settings.
8. Third-Party Services
Our Service integrates with third-party AI providers (OpenAI, Anthropic, Google, xAI, Meta, Mistral). Your use of these AI models is subject to their respective terms of service. We are not responsible for their availability, performance, or policies.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOOKMATE LIMITED SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
11. Indemnification
You agree to indemnify and hold harmless Bookmate Limited and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region, without regard to conflict of law provisions.
